EPC

Since 6 April 2008, an energy performance certificate has been required on rented property in England and Wales. You must have a valid EPC priori to marketing the property, the prospective landlord and agent (if there is an agent) must use all reasonable efforts to secure that a valid energy performance certificate is obtained for the building before the end of a period of 7 days starting with the day on which the building was first put on the market.

The penalty for failing to commission a dwelling before marketing it or failing to make available / provide an EPC to a tenant is £200.00. When the structure is not an inhabited (commercial buildings), the penalty is calculated using the formula in Regulation 38, with a minimum of £500 and a maximum of £5000.

Gas

As a landlord, you are legally obligated to ensure the safety of your tenants in terms of gas safety. You are required by law to:

  • Maintain the safety of gas pipework, flues, and appliances.
  • Ensure that each appliance and flue is subjected to an annual gas safety inspection.
  • Maintain a record of each safety check. "Renew per annum"
  • You should also keep your tenants up to date on their responsibilities while they are living in your home.
